These Terms of Service and End User License Agreement (the “Terms”) are a binding agreement between you and GTStudios LLC (“ThrillZing”, “we”, “us”, or “our”) governing your use of the ThrillZing mobile application and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service you represent that you meet these requirements.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use.
3. License to Use the Service
Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for your personal, non‑commercial use. You may not copy, modify, distribute, sell, reverse‑engineer, or create derivative works of the Service except as permitted by law.
4. Your Content
You retain ownership of the content you create or share (“User Content”). You grant ThrillZing a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, display, and distribute your User Content solely to operate, provide, and promote the Service. You represent that you own or have the necessary rights to your User Content and that it does not violate these Terms or any law or third‑party right.
5. Community Standards — Zero Tolerance for Objectionable Content
There is zero tolerance for objectionable content and abusive users. You agree not to post, share, or transmit content that is unlawful, harmful, harassing, hateful, defamatory, threatening, sexually explicit, that exploits or endangers minors, that depicts or promotes violence or self‑harm, or that is otherwise objectionable. You agree not to harass, bully, threaten, stalk, impersonate, or abuse any person.
6. Reporting, Blocking, and Moderation
The Service provides tools to report objectionable content and to block abusive users. We review reports and act on objectionable content and the users who post it — generally within 24 hours — by removing content and/or suspending or terminating offending accounts. We may remove content, or suspend or terminate accounts, at our discretion and without notice for any violation of these Terms.
7. Prohibited Conduct
You agree not to: (a) violate any law or third‑party right; (b) post objectionable content as described above; (c) upload malware or disrupt or interfere with the Service; (d) scrape, harvest, or collect data from the Service without permission; (e) access accounts or data that are not yours; (f) use the Service to send spam or unsolicited messages; or (g) misrepresent your identity or affiliation.
8. Intellectual Property
The Service, including its software, design, logos, and content we provide, is owned by GTStudios LLC and protected by intellectual property laws. Except for your User Content and the limited license above, no rights are granted to you.
9. Third‑Party Content and Links
The Service may display content, data, or links from third parties (including park and ride information and map imagery). We are not responsible for third‑party content or websites, and your use of them is at your own risk and subject to their terms.
10. Copyright (DMCA)
We respect intellectual property rights. If you believe content on the Service infringes your copyright, contact us at info@gtstu.com with a description of the work, the location of the material, and your contact information. We may remove infringing content and terminate repeat infringers.
11. Feedback
If you send us suggestions or feedback, you grant us a perpetual, royalty‑free license to use it without restriction or obligation to you.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. Ride metrics, g‑force readings, speed, altitude, and location features are estimates provided for entertainment and informational purposes only and should not be relied upon for safety decisions.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GTSTUDIOS LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
14. Indemnification
You agree to indemnify and hold harmless GTStudios LLC from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third‑party right.
15. Termination and Account Deletion
You may delete your account at any time in the app (Profile → Delete Account). We may suspend or terminate your access at any time for any violation of these Terms. Sections that by their nature should survive termination will survive.
16. Apple App Store — Additional Terms
If you obtained the app from the Apple App Store, the following also applies and, in case of conflict for App Store usage, controls:
- These Terms are between you and GTStudios LLC only, not Apple. GTStudios LLC, not Apple, is solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims are GTStudios LLC’s responsibility.
- GTStudios LLC, not Apple, is responsible for addressing any claims relating to the app, including product liability, legal or regulatory non‑compliance, and intellectual‑property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third‑party terms when using the app.
- Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you.
17. Changes to These Terms
We may update these Terms from time to time. We will revise the “Last updated” date above and, where appropriate, provide notice. Your continued use of the Service after changes take effect constitutes acceptance.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States and the State in which GTStudios LLC is organized, without regard to conflict‑of‑laws rules. You agree to resolve disputes in the courts located there, except where prohibited by law.
19. General
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, with the Privacy Policy, are the entire agreement between you and us regarding the Service. We may assign these Terms; you may not. Our failure to enforce a provision is not a waiver.
